Terms of Service
These terms explain how Eknas works (businesses record your purchases, you earn 1 point for every rupee, and you redeem rewards with one-time codes), what you can expect from us, and what we expect from customers and businesses, including how rewards you've unlocked stay protected if a business ends a program or leaves Eknas. We've written them in plain language. Please read them, together with our Privacy Policy, before you use Eknas.
1. About these terms
These Terms of Service (“Terms”) are an agreement between you and Eknas (“Eknas”, “we”, “us”), located in Kathmandu, Bagmati Province, Nepal. They cover the Eknas website, web app, public business pages and every related service (together, the “Service”). The Service is offered in Nepal only.
You accept these Terms, and our Privacy Policy, by ticking the consent box when you create an account or sign in. We record the version you accepted, the date and time, and the IP address and browser used. An agreement made this way is valid under the Electronic Transactions Act, 2063 (2008) and the Contract Act, 2056 (2000). If you don't agree, please don't use the Service.
Eknas is a technology platform. Businesses use it to run their own loyalty programs; Eknas does not sell goods or services to customers and does not provide the rewards. Some sections apply only to customers, and some only to businesses and their staff. Where that is the case, the heading says so.
2. Words we use
- Customer — a person who uses Eknas to collect points and rewards, including a person a Business has added at the counter by mobile number.
- Business — a shop, restaurant, café, salon, gym or other organisation in Nepal that subscribes to Eknas to run a loyalty program.
- Staff — the owner, managers and cashiers a Business adds to its Eknas account.
- Eknas team — our own employees and administrators who run, support and secure the Service.
- Loyalty program — a Business's points program, with its points goal, the rewards it offers and its conditions. A Business may run more than one, where its plan allows.
- Loyalty card — a Customer's digital points card for one loyalty program.
- Purchase — a bill a Business records for a Customer on Eknas: the amount in Nepalese rupees (NPR) and, optionally, a note of what it was for.
- Points — added to a Customer's loyalty card for a Purchase: 1 point for every NPR 1, or 2 points per rupee on the Business's double points days where its plan offers them.
- Reward — the item, service or discount a Business promises when a Customer reaches a set number of points.
- Reward code — a short, single-use code the Customer shows at the counter to collect a Reward.
- Final redemption date — when a loyalty program is ending, the last day Customers can redeem Rewards they have already unlocked, as set out in the Customer Reward Protection Policy.
3. Who can use Eknas, and your account
You must be at least 16 years old to create a Customer account, and we check this from the date of birth you give. If you are under 18, you confirm that a parent or guardian has agreed to you using Eknas. Business accounts must be opened by a person aged 18 or over who is authorised to act for the Business, which must operate lawfully in Nepal.
- Give accurate information, including your real name, a Nepal mobile number you use, your correct date of birth and your address. Keep it up to date.
- One Customer account per person. Don't create accounts for other people or use someone else's mobile number.
- Only enter a mobile number that is yours. If a Business already saved purchases with that number, they join your account only after that Business's staff check in person that you are the same customer and confirm it by scanning your code. Entering someone else's number to take their history or points is misuse, and we will reverse it and may close the account.
- Keep your password private and don't share logins, including Staff logins. You are responsible for activity on your account until you tell us it has been misused.
- We recommend turning on two-step sign-in (a code from an authenticator app) in your account settings.
- Tell us straight away at [email protected] if you think someone else has access to your account.
4. Points and rewards (customers)
Joining a loyalty card
Joining Eknas and joining a loyalty card are free for Customers. You join a Business's loyalty card by scanning its QR code, by showing your Eknas code to its staff, or from the Business's page in the app. When you join, that Business can see the details described in our Privacy Policy.
Earning points
- 1 point for every rupee. When you buy something, staff record the bill amount on Eknas and you earn 1 point per NPR 1. On a Business's double points days (where offered), you earn 2 points per rupee.
- Staff record a purchase after you scan the live QR code at the counter, when they scan your live Eknas code, or when they find you by your mobile number. There is no daily limit: every real purchase counts.
- Staff may add a short note of what the purchase was for. Large bills need a second confirmation by staff.
- You can see every purchase recorded on your cards, with its amount, note, date and points, in the app.
- Live QR codes change regularly and expire within minutes. Photographing, sharing or reusing a code to collect points you did not earn is not allowed.
- A Business may void a purchase recorded by mistake, which takes its points back, may correct points, and may put a card on hold if it suspects misuse.
- A Business may set its points to expire after a period it chooses (at least 30 days). Points earned before it turned expiry on don't expire. The app shows when points run out and reminds you shortly before they do.
- Eknas doesn't handle payments between you and a Business. You pay the Business directly, and the amounts recorded on Eknas are for loyalty points only. They are not a tax invoice or a receipt for tax purposes.
Added at the counter
If you don't use the Eknas app yet, a Business's staff can add you with your mobile number and name, with your permission, so your purchases earn points. If you later sign up with the same mobile number, that Business's history and points join your account the next time its staff confirm in person that it's you, by scanning your code. If you and that number both have a card at the same Business, the cards are then combined.
Rewards
- Each Business decides its own rewards, how many points they need, how long they stay valid, and any conditions. These are shown on its loyalty card.
- To redeem, press Redeem in the app while you are at the counter. You receive a Reward code that works once and expires after 15 minutes. After staff enter it, the code can never be used again.
- When you redeem the main reward at a Business's points goal (or it lapses), a new round begins. Points above the goal carry over into the new round.
- Points and rewards have no cash value, cannot be exchanged for money, and cannot be transferred, sold or moved to another person or Business.
- Rewards that pass their expiry date lapse and cannot be restored.
Who provides the reward
The Business, not Eknas, issues the points, provides every reward and is responsible for its quality, availability and any claim about it. It is also responsible for the goods and services you buy. Eknas provides the technology that records purchases, points and codes. Your rights under the Consumer Protection Act, 2075 (2018) against the Business are not affected.
If a business ends a program or leaves Eknas
You won't lose rewards you have already unlocked without warning. Businesses must follow our Customer Reward Protection Policy, which in short means:
- You are told. Every customer with a card for the program gets a notice in the Eknas app (notifications) showing the date earning stops and the exact final redemption date.
- You get time. You have at least 30 days after earning stops to redeem rewards you have already unlocked. Rewards that would have expired sooner stay valid until the final redemption date.
- You get reminders a week before and a day before the final redemption date.
- Your record stays. After the final redemption date, unused rewards expire and no new points are added, but your card, points and purchase history stay in your Eknas account.
- If the business comes back, its program can start again and your points carry on.
- Points that haven't reached a reward can't be exchanged for cash or moved to another business.
5. Ratings, reviews and replies
After a purchase recorded on your card, you can rate the Business from 1 to 5 stars and add a comment. Ratings count towards the Business's public rating on its Eknas page, and comments are shown publicly there with your first name and last initial and a “Verified visit” label. By posting a comment you let us show it on Eknas for as long as your account is open.
- Reviews must be honest, about your own visit, and must not contain other people's personal information, threats, hate, or unlawful content.
- A Business may reply publicly to a review. Replies must be polite, must not reveal anything about the customer beyond what the review shows, and must not offer anything in exchange for changing a rating.
- Businesses must not reward, pressure or ask customers for positive ratings, or post ratings about themselves or competitors.
- We may hide reviews or replies that break these rules, and suspend accounts that repeatedly do so. We don't edit what people write, and reviews are the views of the people who wrote them, not of Eknas.
Google reviews
Businesses on the Pro plan can add a link to their Google Business Profile. After you rate a purchase, Eknas may then invite you to also review the Business on Google. Posting there is your choice: you post the review yourself, from your own Google account, under Google's terms, and Eknas never posts for you. Every rater is invited, whatever their rating. Businesses must not offer points, rewards or discounts for a Google review, or ask only happy customers to post one.
6. Acceptable use
When using Eknas you must not:
- collect points or rewards dishonestly, including with fake accounts, other people's codes or mobile numbers, or copies of QR codes;
- record fake bills or purchases that didn't happen, change bill amounts, or redeem rewards for people who are not present (staff);
- look up customers by mobile number, or add them at the counter, unless the customer is present and has asked you to (staff);
- interfere with, overload, scan for weaknesses in, or try to get around the security, rate limits or plan limits of the Service;
- copy, scrape, crawl or harvest the Service or its data by automated means (other than through the Eknas developer API with a key we issued), or resell it;
- decompile, reverse engineer or copy the Service's software, except as far as the law allows despite this restriction;
- use someone else's account, share logins, or pretend to be someone else, including a member of the Eknas team;
- send misleading, offensive, discriminatory or unlawful messages or content through Eknas;
- use Eknas in breach of any law of Nepal.
We may remove points or rewards gained in breach of these rules, undo a link to a mobile number that isn't yours, and suspend or close the accounts involved.
7. Subscriptions and payment (businesses)
- Trial. New Businesses get a free 3-day trial. No payment is taken during the trial.
- Prices. Plans are priced per location, in Nepalese rupees (NPR), and include 13% VAT. Current prices are shown in Billing before you ask for any change.
- How you pay. Eknas doesn't take card payments or debit your account automatically. To start or change a plan, you ask for it in Billing, pay using the Eknas payment QR code or account details shown there (such as eSewa, Khalti, Fonepay or bank transfer), and upload a screenshot of the payment with its reference number if you have one. The Eknas team checks the payment and approves the request, or declines it and tells you why. Nothing changes on your subscription until the request is approved, and we issue an invoice for each approved payment.
- Renewal. Subscriptions run for the billing cycle you choose (monthly, yearly or three years). When a period, or the trial, ends, we issue a renewal invoice for the next period. If it is still unpaid 14 days after it was issued, the account is suspended, which stops new points and offers until it is settled. Customers can still redeem rewards they have unlocked, as the Customer Reward Protection Policy sets out.
- Changing plan. A change that costs more (a higher plan, a longer cycle or more locations) starts a new period from the day it is approved, and the unused part of your current period is credited against its price. A change that costs less takes effect at your next renewal.
- Plans with fewer programs. Before moving to a plan that runs fewer loyalty programs, the Business must retire the extra programs, and their customers get a redemption period under the policy.
- Cancellation. The owner can cancel the subscription at any time in Billing. It ends at the end of the period already paid for (or straight away during a trial, or when the account is past due or suspended), and the Customer Reward Protection Policy applies to every running program. Until then the owner can change their mind and keep the subscription.
- Refunds. Payments for a period that has started are not refundable, including when you cancel part-way through it. We will refund, or credit, an amount where the law requires it or where we made a mistake, such as a duplicate payment, a payment for a request we declined, or a period in which we could not provide the Service because of a fault on our side. Contact us at [email protected] as soon as you notice the problem.
- Discounts and promo codes are subject to their stated limits and cannot be exchanged for cash.
8. Business responsibilities and customer data
By running a loyalty program on Eknas, the Business agrees to:
- honour every reward shown on its loyalty program for customers who reached it, until the reward expires or, if the program is ending, until its final redemption date;
- follow the Customer Reward Protection Policy whenever it retires a program, changes plan or leaves Eknas;
- describe its rewards, points expiry and conditions accurately, and not change them in a way that takes away rewards customers have already unlocked;
- never charge customers a fee to join its loyalty card or to use Eknas;
- give each staff member their own login, keep those logins secure, remove staff who leave, and take responsibility for everything its staff do on Eknas;
- record only real purchases, with the correct bill amount, and void mistakes promptly;
- add or look up a customer at the counter only when the customer is present and agrees, using the mobile number they give;
- not promote offers that are unlawful or misleading, or that target minors with alcohol, tobacco or similar products.
Customer information
Members' names, mobile numbers, dates of birth, addresses (street or tole, city and district), hobbies and purchase history are shared with a Business so it can run its loyalty card and, where the customer allows it, send offers, events and birthday messages that suit them. For its own use of this information, including anything it exports or copies outside Eknas, the Business decides how it is used and is responsible for it under the law. The Business must:
- use this information only for its own loyalty program and its own marketing to those members;
- send marketing only to members who have agreed to receive offers, respect each member's notification choices, and stop contacting a member who asks it to;
- never sell, rent or give the information to anyone else;
- keep any exported files secure, limit access to people who need it, and delete them when no longer needed;
- comply with the Individual Privacy Act, 2075 (2018), its Regulation, and every other law that applies to personal information, including when contacting members outside Eknas;
- tell us promptly at [email protected] about any loss or misuse of member information.
Phone lookups at the counter are limited per day and recorded. We may suspend exports, messaging or lookups for any Business that misuses member information.
AI tools
Some plans include AI-assisted tools, such as drafting offers and replies to reviews, suggesting reward ideas, and insights from the Business's own figures. They are provided using AI models from Google (Gemini) and, as a fallback, Groq, as described in our Privacy Policy. AI can make mistakes: suggestions are drafts, and the Business is responsible for what it publishes, offers or sends. Don't enter customers' personal details into free-text AI prompts.
Contacting businesses
Eknas's sales team may contact a business using contact details the business has made public, found with the help of an AI web search tool. A business can ask us to stop at any time at [email protected].
9. Developer API and webhooks (businesses)
On plans that include it, the Eknas team can set up access to the Eknas developer API and webhooks on request, so a Business can connect its own point of sale, app or website. Systems the Business connects receive that Business's own customer and purchase data, such as names, partly hidden mobile numbers, cards, points, purchases and rewards.
- The Business is responsible for the systems it connects and for anyone who builds or runs them for it, and must protect them and its API keys and webhook secrets like its own passwords.
- Data received through the API or webhooks is covered by the duties in Business responsibilities and customer data.
- Requests are rate limited. We keep request and delivery logs for 30 days, and we may switch off a key or webhook that is misused, compromised or repeatedly failing.
10. Customer Reward Protection Policy (businesses)
This policy protects what customers have earned. It is part of these Terms and is binding on every Business (policy version 2026-09-29). Customers can read a short summary in Points and rewards.
1. No silent endings
A Business may retire a loyalty program, move to a plan that runs fewer programs, or cancel its subscription and leave Eknas. It may not do any of these silently, and it may not take away rewards customers have already unlocked in any other way. Eknas carries out the steps below itself, so they happen whatever the reason a program ends, including when a subscription isn't renewed or an account is suspended.
2. Every customer is told
As soon as a program starts ending, Eknas notifies every customer who has a card for it in the Eknas app (notifications). The notice shows the date earning stops and the exact final redemption date. The same dates are shown on the customer's card and at the counter, and Eknas sends reminders 7 days and 1 day before the final redemption date.
3. When earning stops
- When a Business cancels, customers keep earning points until the end of the period it has already paid for.
- Earning stops straight away when a Business on a free trial cancels, when a trial or renewal invoice is still unpaid 14 days after it was issued (the account is then suspended), or when Eknas suspends the account for another reason.
- When a Business retires a single program, earning on that program stops from the date shown when it confirms.
4. Time to redeem
- Customers keep at least 30 days after earning stops to redeem rewards they have already unlocked. The Business may give them longer, up to 180 days. If it doesn't choose, they get 60 days.
- Unlocked rewards that would expire before the final redemption date are extended to that date.
- Until the final redemption date the Business must honour every unlocked reward presented with a valid reward code, even if its subscription has already ended. The counter stays open for redemptions during this time.
- Eknas may give customers more time by moving the final redemption date later. It is never moved earlier.
5. Points below a reward
Points that haven't reached a reward have no cash value. Neither the Business nor Eknas exchanges them for cash, goods or points at another business.
6. After the final redemption date
The program ends: unused rewards expire and their reward codes stop working, and no new points are added. Eknas keeps each customer's card, points and purchase history as a record in the customer's account, under the retention rules in our Privacy Policy.
7. Changing its mind or coming back
- A Business that cancelled can keep its subscription at any time before the cancellation takes effect. Its programs carry on and customers are told.
- If a Business returns after its cancellation took effect, its programs can start again and customers' points carry on from where they were.
8. Accepting this policy
The Business accepts this policy when it signs up, each time it creates a loyalty program, and when it cancels its subscription. We record the version accepted, when, and by whom.
11. Notifications, emails and offers
Eknas tells you about your account in the app's notifications: a welcome message, a receipt after each purchase recorded on your card, when a reward is ready or has been redeemed, when points are about to expire, and when a program you hold a card for is ending, nearly at its final redemption date, continuing or has ended. Reward codes, important account messages and program-ending notices are always shown in the app.
If you allow it, you also receive offers, events and birthday messages from Businesses you have joined, and occasional news from Eknas, in the app. You can change these choices at any time in your profile. Businesses are responsible for the content of the offers they send.
The only emails Eknas sends are for account security: a password reset code or link, and a notice when your password has been changed. If we ever send you any other kind of email, it will have a one-click unsubscribe link.
12. Intellectual property and your content
Eknas, its software, design and brand belong to us or our licensors. We give you a limited, non-exclusive, non-transferable right to use the Service under these Terms, for as long as your account is active.
Businesses keep ownership of their names, logos, cover images, menus, photos and descriptions, and Customers keep ownership of their reviews. You give us a free, non-exclusive licence to store, copy, resize and display that content in the Service, on public business pages and in search results for them, for as long as it is on Eknas and for a reasonable time after it is removed. You confirm that you have the right to upload it and that it doesn't break anyone else's rights.
If you send us suggestions or feedback, we may use them to improve Eknas without owing you anything.
13. Other services we use
Eknas is hosted by Hostinger and delivered through Cloudflare. Maps use tiles from OpenStreetMap, openstreetmap.fr and Esri; address search uses OpenStreetMap's Nominatim service; and directions open in Google Maps. Google review links open Google. AI features use models from Google (Gemini) and Groq, and security emails are delivered by Brevo. Those services have their own terms, and we aren't responsible for their content or availability. Our Privacy Policy explains what information they receive.
14. Changes and availability
We work to keep Eknas available and secure, but we don't promise it will always be uninterrupted, error-free or suitable for every purpose. The Service may be unavailable during maintenance, or because of events outside our reasonable control, such as power or internet outages, failures of our providers, natural disasters, strikes or government action.
We may change or improve features. We will give Businesses reasonable notice in the app of changes that significantly reduce what their plan includes. Businesses should keep their own records of anything they need for tax or accounting.
15. Suspension and closing accounts
Customers can delete their account at any time from their profile. Businesses can cancel their subscription in Billing, or close their account by contacting us, and the Customer Reward Protection Policy applies either way.
We may suspend or close an account, or limit features on it, if it breaks these Terms, if we reasonably believe it is involved in fraud or misuse or puts other users at risk, if a Business's invoice stays unpaid, or where we are required to by law. Where it is reasonable and lawful, we will tell you why and give you a chance to respond.
Sections that by their nature should continue after an account closes — including payment obligations, the Customer Reward Protection Policy, data duties, limits of liability, indemnity and disputes — continue to apply.
16. Our responsibility to you
To the extent permitted by the laws of Nepal, the Service is provided “as is” and “as available”. We are not responsible for rewards, points, products or services provided by Businesses, for what Businesses or other users do, or for losses that were not reasonably foreseeable, including lost profits, lost business or lost data caused by events outside our control.
Where we are responsible, our total liability for all claims is limited: for a Business, to the fees it paid Eknas in the three months before the claim arose; for a Customer, who pays Eknas nothing, to NPR 5,000.
Nothing in these Terms limits or excludes liability for fraud, for deliberate wrongdoing, or for anything else that cannot be limited or excluded under the laws of Nepal, and nothing affects your rights as a consumer under the Consumer Protection Act, 2075 (2018).
17. Indemnity (businesses)
A Business agrees to compensate Eknas for losses, claims, fines and reasonable legal costs that arise because the Business or its staff broke these Terms or the law, failed to honour a reward, misused customer information (including through systems connected to the developer API), or uploaded content they had no right to use. We will tell the Business promptly about any such claim and let it take part in responding to it.
18. Changes to these Terms
We may update these Terms, for example when the law or the Service changes. The version and effective date at the top will change, and you will be asked to accept the new version the next time you sign in. We will tell you in the app before a change that significantly affects you takes effect, unless it is needed urgently for legal or security reasons. If you don't agree with the changes, you can stop using Eknas and delete your account, or, for a Business, cancel its subscription.
19. Governing law and complaints
These Terms are governed by the laws of Nepal, including the Contract Act, 2056 (2000), the Electronic Transactions Act, 2063 (2008) and the Consumer Protection Act, 2075 (2018).
If something goes wrong, please contact us first at [email protected], or write to the Grievance Officer, Eknas. We aim to acknowledge complaints within three working days and resolve them within 30 days. If a dispute can't be settled by discussion within 30 days, it may be taken to the competent courts in Kathmandu, Nepal, without affecting any right you have to approach a consumer court or other authority under Nepali law.
20. General
- Whole agreement. These Terms, the Customer Reward Protection Policy and our Privacy Policy are the whole agreement between you and Eknas about the Service, and replace anything agreed before about it.
- Severability. If a court finds any part of these Terms invalid or unenforceable, that part is changed as little as needed to make it valid, and the rest stays in force.
- No waiver. If we don't enforce a right straight away, we can still enforce it later.
- Transfer. You may not transfer your account or these Terms to anyone else. We may transfer them to a company that takes over the Service, and will tell you if we do; your rights under these Terms are not reduced.
- Language. These Terms are written in English. If we provide a translation, the English version prevails where they differ.
- Notices. We may send you notices in the app or to the email address on your account. You can send notices to us at the addresses below.
